Waiver of Subrogation
What this clause says
Manufacturer waives all rights of subrogation against Sponsor, its parents, subsidiaries, and affiliates under all insurance policies required hereunder.
What this means in plain English
If your insurer pays a claim, they cannot turn around and try to recover the money from the sponsor.
What it means for a CDMO program
Easy to add via a blanket waiver endorsement on CGL, Auto, WC, and umbrella. Your carrier typically charges a small premium increase for WC waiver in particular (often required by NCCI). Confirm the waiver applies to all policies the MSA references, not just CGL.
